- Read the Protecting Tenants in Foreclosure
Act of 2009. Under this new law enacted May 21, 2009, bona fide tenants have
the following rights:
- You have the right to receive notification 90 days before you can be evicted from
a property in foreclosure.
- If you have a lease, you may occupy the property until the end of your lease unless
the foreclosed property is sold to a new owner who plans to use the property as
their residence. If this happens, you can stay at the property until 90 days after
you receive notification.

help determine whether you are eligible for programs that could make paying your
bills a little easier.

- Renters in Fannie Mae-Owned Foreclosed Properties May Be Able To
Stay In Their Homes
- Under a new Fannie Mae policy, called Tenant-in-Place, eligible renters who want
to stay in a home that has been foreclosed can sign a month-to-month lease if the
property is owned by Fannie Mae. The policy, which applies to Fannie Mae-owned properties,
aims to stabilize communities affected by high foreclosure rates.
- Eligible renters will be offered a new month-to-month lease with Fannie Mae and
Fannie Mae will manage the properties through a real estate broker or a property
management company. Renters may also be eligible for financial assistance if they
desire to relocate
