Is Your Landlord in Foreclosure?
Important Information for Tenants to Know

  • Read "Is Your Landlord in Foreclosure? Important Information for Tenants" which contains frequently asked questions.
  • Go to www.ohiolegalservices.org/programs or call 1-866-LAW-OHIO (1.866.529.6446) to get more information or legal assistance.
  • Read the Protecting Tenants in Foreclosure Act of 2009. Under this new law enacted May 21, 2009, bona fide tenants have the following rights:
    • You have the right to receive notification 90 days before you can be evicted from a property in foreclosure.
    • If you have a lease, you may occupy the property until the end of your lease unless the foreclosed property is sold to a new owner who plans to use the property as their residence. If this happens, you can stay at the property until 90 days after you receive notification.

  • The Ohio Benefit Bank (800.648.1176) can help determine whether you are eligible for programs that could make paying your bills a little easier.
  • The Ohio Office of Family Stability offers information about supportive services, food programs, and cash programs.
  • Renters in Fannie Mae-Owned Foreclosed Properties May Be Able To Stay In Their Homes
  • Under a new Fannie Mae policy, called Tenant-in-Place, eligible renters who want to stay in a home that has been foreclosed can sign a month-to-month lease if the property is owned by Fannie Mae. The policy, which applies to Fannie Mae-owned properties, aims to stabilize communities affected by high foreclosure rates.
  • Eligible renters will be offered a new month-to-month lease with Fannie Mae and Fannie Mae will manage the properties through a real estate broker or a property management company. Renters may also be eligible for financial assistance if they desire to relocate
